Terms of service

  1. Scope of Application
    The AGB apply to contracts between Vanessa Lazarcuks and customers (consumers and entrepreneurs) regarding the delivery of goods offered on the online shop.

  2. Conclusion of Contract

    • The product descriptions on the website are not binding offers but serve as a basis for customers to make binding offers.
    • A contract is concluded once the seller accepts the customer's offer, either through an order confirmation, delivery of goods, or payment request.
    • Customers can place orders via the online order form. The customer’s order is legally binding upon submission.
    • The contract can be concluded in different languages, as shown in the online store.
  3. Right of Withdrawal
    Consumers have the right to cancel the contract within 14 days without providing reasons. Specific instructions are given in the seller's Widerrufsbelehrung (Right of Withdrawal section).

  4. Prices and Payment Terms

    • The prices are total prices, including VAT. Additional delivery and shipping costs are specified separately.
    • Various payment methods, such as PayPal and Shopify Payments, are available. Payment services are provided by third-party companies (e.g., Stripe).
  5. Delivery and Shipping Conditions

    • Goods are delivered to the customer's address within the specified delivery area. If the delivery fails due to the customer's fault, the customer is responsible for the associated costs.
    • The risk of loss or damage to goods is transferred to the customer once the goods are handed over to the carrier.
  6. Retention of Title
    The seller retains ownership of the goods until full payment is made.

  7. Warranty

    • The warranty conditions are in line with legal requirements, but specific provisions apply to both consumers and entrepreneurs, such as shorter warranty periods for entrepreneurs or used goods.
    • The seller’s liability for defects does not extend to cases where the defect was not reported or if the customer used the goods inappropriately.
  8. Liability

    • The seller is fully liable in cases of intent, gross negligence, or violations of life, body, or health.
    • For ordinary negligence, the seller's liability is limited to predictable, contractual damages.
    • The seller is not liable for indirect damages.
  9. Applicable Law
    German law applies to all legal relationships between the parties, excluding international sales law. Consumers are still protected by mandatory laws of their country of residence.

  10. Alternative Dispute Resolution

  • The EU offers an online platform for dispute resolution, which can be accessed at ODR platform.
  • The seller is not obligated to participate in alternative dispute resolution through a consumer dispute resolution body.
